Summary

SEC Litigation Release No. 26648 says the agency filed settled charges on September 24, 2026, in SEC v. Kristopher A. Lunsford, et al., No. 8:26-cv-02923, in the Middle District of Florida. The complaint alleges Lunsford, AKL Transport LLC and Southern Truck Leasing LLC raised at least $127 million from approximately 765 investors nationwide, many near Tampa, from at least May 2023 through May 2025. Investors were told their money would buy discounted commercial semi-trucks, with the defendants managing drivers, cargo, insurance and maintenance. The defendants allegedly claimed to operate approximately 2,000 trucks and promised $1,250 in net weekly returns per assigned truck for five years, about 260% annually, funded by transport fees.

The SEC alleges approximately $52 million, about 40% of deposits, instead came from new investors and paid earlier investors, while Lunsford misappropriated approximately $33 million, about 25% of investor funds. Alleged personal spending included nearly $10 million in cash withdrawals, approximately $6.2 million for travel, bars and nightclubs, and at least $1.9 million in casino-related expenses. The SEC also says the 2,000-truck claim was materially overstated. On September 25, 2026, the U.S. Attorney’s Office for the Middle District of Florida announced parallel mail and wire fraud charges against Lunsford.

Without admitting the allegations, the defendants consented to court-approved bifurcated judgments imposing injunctions under Securities Act of 1933 Section 17(a), Exchange Act of 1934 Section 10(b) and Rule 10b-5. Lunsford would be permanently restricted from securities transactions except certain personal-account activity. Disgorgement, prejudgment interest and civil penalties remain for later determination. Ernesto Palacios, Andre J. Zamorano and Karaz S. Zaki are conducting the continuing SEC investigation under Jason R. Berkowitz, Fernando Torres and Stephanie N. Moot. Michael Mikulic leads the litigation under Russell Koonin, with assistance from federal prosecutors and the FBI’s Tampa Field Office.

Positives

  • The defendants consented to bifurcated judgments and federal securities law injunctions, subject to court approval.
  • The court may later order disgorgement, prejudgment interest and civil penalties on the SEC’s motion.
  • The SEC’s investigation remains active with assistance from federal prosecutors and the FBI’s Tampa Field Office.
  • Parallel criminal charges announced September 25, 2026, allege mail and wire fraud by Lunsford.
